Description

Environmental Responsibilities Law New South Wales provides wide coverage of the environmental legislation. Overall ERLS provides awareness of rights, obligations and responsibilities in relation to protecting the environment, climate change and water regulatory compliance issues and exposure to potential liability and penalties. The authoring team – Jeff Kildea,  Zaina Shahnazwaz, Olia Koudrina and Dr Rachel Baird – provide practical commentary on the major legislative provisions, significant reported and unreported judgments, environmental developments, environmental audit and compliance programs. 
Specialist chapters in the service include: 
  • "Environmental Regulation" by The Hon Justice Brian Preston, Chief Judge of the Land & Environment Court NSW.
  • Jeff Kildea, Acting Commissioner of the Land and Environment Court provides annotations and commentary to the Land and Environment Court Act and Regulation and populates with cross-references to relevant and more extensive commentary in Thomson Reuter's Planning & Development Service NSW and Land and Environment Court NSW service. This creates companion services across the environmental and planning products.
  • "Climate Law" authored by Rebecca Dixon of Mallesons Stephen Jacques with the Supervising Editor, Rosemary Lyster, Associate Professor in the Faculty of Law and Director of the Australian Centre for Environmental Law at the University of Sydney and legal consultant at the Sydney office of Mallesons Stephen Jaques. This chapter discusses climate law and policy, the international legal framework, emissions trading schemes, reporting on greenhouse gas emissions and energy consumption, discussion around the Carbon Pollution Reduction Schemes and planning, development control and climate change. Updated in its entirety by Cassandra May BSc (Environmental) LLB (Hons) (Syd), solicitor with the Department of Environment, Climate Change and Water (DECCW).
  • "Biodiversity", revised by author Cassandra May BSc (Environmental) LLB (Hons) (Syd) Legal and Policy framework for biodiversity protection in Australia; Legislation of biodiversity in NSW; Protection of individual species, populations and ecological communities; Relationship between threatened species protection in NSW and protection under the Environmental Protection and Biodiversity Conservation Act 1999 (Cth) and Biobanking are discussed. 
  • The area of water management continues to be expanded to provide subscribers with the information required to face these emerging changes and issues. NSW water legislation has been added to the service, starting with the Water Management Act 2000 and the Water Management (General) Regulation 2004. This chapter is maintained by Olia Koudrina of NSW Trade & Investment.
Legislation in this service has cross-referencing notes which explain the relationship of the provisions of the Act with the provisions of the Regulation; the Environmental Law Locater is a legislation matrix of the environmental law legislation for each jurisdiction. The locater clearly shows with which environmental matters specific legislation deals.
