BookNZ Judicial Review Handbook 2nd edition

Building on the material in the 1st edition, the 2nd edition of the Handbook will be the most comprehensive and authoritative guide to cases that impact the law of judicial review and the principles that underpin them.

The book meets the needs of practitioners, and covers all the stages of judicial review processes and contains pinpoint references to cases to support propositions in the commentary. It also includes key provisions from legislation relevant to judicial review. The book is modelled on the successful English text Fordham’s Judicial Review Handbook.

The first edition of the Handbook has a reputation amongst our High Court Judges as a strong and authoritative work that they refer to when judicial review matters are brought before them. Both Justices Wild and Kos have informed me of this on more than one occasion.

Matthew Smith, Barrister and an acknowledged expert on the law of judicial review will author the 2nd edition.

Since the 1st edition was published in 2011 there has been four years of case-law development in the area of judicial review. Measuring those developments in a ‘Cases’ search for “judicial review” in the ‘Free Text’ field of Westlaw’s BriefCase database, you  get a return of 1,435 results for the period from 1 July 2011 to 17 November 2015. Matthew intends to capture those developments in the case-law and to use the 2nd edition (as he did for the first edition) to render the voluminous judicial review case-law accessible and knowable to the busy practitioner.

He also proposes to include a new stand alone chapter on Property Rights, recognising the growing significance that property rights arguments are coming to have in the judicial review (and constitutional) cases that are more commonly being advanced before our Courts.
